1. Acceptance of Terms

By accessing or using Heartbeat AI ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.

2. Description of Service

Heartbeat AI is a multi-tenant AI-powered knowledge platform that provides:

• Document upload, processing, and vector embedding storage
• AI-powered question answering using retrieval-augmented generation (RAG)
• Embeddable chat widgets for websites
• Dynamic forms, interactive pages, and multi-agent AI pipelines
• Analytics and usage dashboards

3. Accounts

• You must use a valid Google account (Gmail or Google Workspace) to sign in
• You are responsible for all activity under your account
• Company admins are responsible for managing their team members' access
• You must not share your session tokens or allow unauthorized access

4. Subscription & Billing

• Free tier accounts are subject to usage limits (documents, queries, storage)
• Paid subscriptions (Starter, Pro) are billed monthly via Stripe
• You may cancel at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis
• We reserve the right to change pricing with 30 days' notice

5. Acceptable Use

You agree not to:

• Upload illegal, harmful, or infringing content
• Attempt to access other companies' data or bypass security controls
• Use the Service to send spam, phishing, or malicious content
• Reverse-engineer, scrape, or abuse the API beyond your plan's limits
• Use automated tools to create fake accounts or circumvent rate limits
• Resell access to the Service without authorization

6. Your Data

• You retain ownership of all documents and data you upload
• You grant us a limited license to process your data solely to provide the Service
• We do not use your documents to train AI models
• You are responsible for ensuring you have the right to upload any content
• You may export or delete your data at any time

7. AI-Generated Content

• AI responses are generated based on your uploaded documents and may contain errors
• You are responsible for verifying the accuracy of AI-generated content before relying on it
• Interactive pages, quizzes, and reports generated by the AI are provided as-is
• We are not liable for decisions made based on AI-generated content

8. Embeddable Widgets

• Widget queries count against your monthly query quota
• You are responsible for configuring origin restrictions to prevent unauthorized use
• Widget responses reflect your knowledge base; you are responsible for the accuracy of your documents

9. Service Availability

• We strive for high availability but do not guarantee uninterrupted service
• Scheduled maintenance will be communicated in advance when possible
• We are not liable for downtime caused by third-party providers (Google Cloud, Stripe, AI providers)

10. Limitation of Liability

To the maximum extent permitted by law, Heartbeat AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Termination

• You may cancel your account at any time
• We may suspend or terminate accounts that violate these terms
• Upon termination, your data will be retained for 30 days before permanent deletion

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or platform notification.
